Özet
3 boyutlu baskı teknolojilerinin gelişimi ve 3 boyutlu yazıcıların ucuzlayıp yaygınlaşması, geleneksel üretim yöntemlerine kıyasla daha az maliyetle, daha kısa sürede ve daha az zahmetle üretim yapma imkânı doğurmuştur. Bu teknoloji sayesinde 3 boyutlu yazıcı kullanıcıları, bilgisayar destekli tasarım dosyaları (CAD) aracılığıyla çoğu zaman tek bir tuşa basarak üretim yapabilir hale gelmiştir. Bu olgu, teknoloji ve inovasyonla yakından ilişki içerisinde olan patent hukukunu doğrudan etkilemektedir. Bu bağlamda, CAD dosyalarının kolaylıkla paylaşılabilmesi ve bu dosyalar kullanılarak hızlı ve zahmetsiz biçimde üretim yapılabilmesi patent sahiplerinin tekel haklarının ihlalini gündeme getirmektedir. Bu çalışmanın amacı, Türk hukukunda 3 boyutlu baskı yapan yazıcılar aracılığıyla işlenen patent hakkı ihlallerini tartışmak ve gerekli görülen yerlerde çözüm önerisinde bulunmaktır. Bu amaç doğrultusunda öncelikle kavramsal açıklamalara yer verilmiş, sonrasında patent hakkına tecavüz konusuna yer verilmiş ve nihayetinde 3 boyutlu baskı yapan yazıcılar ve patent ihlalleri ile çalışma sonlandırılmıştır.

The advancement of 3D printing technologies and the decreasing cost and increasing accessibility of 3D printers have enabled production to be carried out at lower cost, in a shorter time, and with less effort compared to traditional manufacturing methods. Thanks to this technology, users of 3D printers have become able to produce objects—often at the press of a single button—by utilizing computer-aided design (CAD) files. This phenomenon has a direct impact on patent law, which is inherently intertwined with technology and innovation. In this context, the ease with which CAD files can be shared and the ability to rapidly and effortlessly manufacture objects using these files bring about the risk of infringing the exclusive rights granted to patent holders.The aim of this study is to examine instances of patent infringement committed through the use of 3D printers under Turkish law and to offer proposed solutions where deemed necessary. To this end, the study first provides conceptual explanations, then addresses the issue of patent infringement, and finally focuses on 3D printing technologies and their relationship to patent violations, thereby concluding the analysis.
